Welcome to the website of WD Thomas Homes NGA LLC (“WD Thomas Homes,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of this website (the “Site”). By visiting or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About Us

WD Thomas Homes is an award-winning custom home builder in North Georgia, with more than 500 homes built since 1992. We build custom homes, major home remodels, and design-build projects across Hall, Forsyth, Dawson, and Lumpkin Counties.

2. Use of the Site

You may use the Site for lawful purposes only, to learn about our company and services, view our featured projects, read our blog, and get in touch with us. You agree not to:

• Use the Site in any way that violates applicable law or regulation;
• Attempt to gain unauthorized access to the Site, its servers, or any related systems;
• Interfere with or disrupt the Site or the experience of other visitors;
• Submit false, misleading, or unauthorized information through our forms.

3. General Information Only

The content on this Site, including project descriptions, photos, blog posts, pricing guidance, and timelines, is provided for general informational purposes only. It is not an offer, a quote, a bid, or a contract, and it is not professional, legal, or financial advice.

For example, our custom homes typically start around $800,000, not including the lot, but that figure is a general guide and not a price for any particular project. The scope, cost, and schedule of your project are set out only in a written contract signed by you and WD Thomas Homes.

4. Inquiries and Our Process

Submitting an inquiry or contact form does not create a contract or a builder-client relationship. A relationship begins only when a written contract has been prepared, reviewed, and signed by everyone named on it. Our process, including the contract, lender review, selections, and scheduling, is described on our Our Process page and is provided as a general overview. The terms of your signed contract control if they differ from anything described on the Site.

As described on our Our Process page, we ask that each project have one designated decision-maker who signs off on every item needing approval, and that selections for items such as appliances, flooring, plumbing, and light fixtures are made early enough to keep the project on schedule. If you are financing your build, we ask for a pre-approval from a lender who does construction-to-perm loans before going any further. You are not required to finance through the bank we know and work with.

We may decline an inquiry or a project at our discretion, including when a project falls outside our service area or scope of work, or when your expectations for the project and its cost do not line up.

5. Warranties

Warranty coverage for a home we build is set out in your written contract and any warranty documents provided to you at completion. Descriptions of warranties on the Site are summaries only.

Our homes include a 1-year standard builder warranty and a 10-year structural warranty. We are also an approved 2-10 Home Warranty builder, so you may add a third-party warranty at completion of construction for an additional cost. That third-party warranty only takes effect in the event of builder default.

New appliances are covered by their manufacturers, and many carry coverage for 2 years. Manufacturer warranties are provided by the manufacturers and governed by their own terms, and homeowners should send in the manufacturer warranty cards upon closing on the house.

6. Projects, Photos, and Testimonials

Photos and descriptions of featured projects show examples of our past work. Every home is different, and the finishes, features, and results shown may not be available or achievable for every project. Testimonials reflect the experiences of the individuals who gave them and do not guarantee any particular result.

7. Intellectual Property

The Site and everything on it, including text, photographs, graphics, logos, and design, belongs to WD Thomas Homes NGA LLC or its licensors and is protected by copyright, trademark, and other laws. You may view the Site and share links to it for personal, non-commercial use. You may not copy, reproduce, modify, distribute, or use any of our content for commercial purposes without our prior written permission.

8. Third-Party Links and Services

The Site may link to or embed third-party websites and services, including social media platforms, our contact form provider, and the websites of architects, designers, suppliers, and warranty providers. We do not control and are not responsible for their content, availability, or practices, and your use of them is governed by their own terms and policies.

9. Privacy

Your use of the Site is also subject to our Privacy Policy, which explains how we collect, use, and protect your information.

10. Disclaimer of Warranties

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, WD Thomas Homes makes no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, or availability of the Site or its content. We do not guarantee that the Site will be uninterrupted or error-free. Any reliance you place on information on the Site is at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law, WD Thomas Homes and its owners, employees, and agents will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data or profits, arising out of or in connection with your use of, or inability to use, the Site. Nothing in these Terms limits any rights or obligations set out in a signed construction contract, which is governed by its own terms.

12. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to its conflict of law principles. Any dispute relating to these Terms or the Site will be handled in the state or federal courts located in Georgia.

13. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date at the top of this page shows when they were most recently revised. Your continued use of the Site after any changes means you accept the updated Terms.
